Welcome to Mode Society! Thanks for joining our Affiliate program.

These following terms and conditions apply to individuals who are accessing or using the Program both as a merchant (“we” or “merchant”) and an affiliate (“you”, “affiliate” or “publisher”) who refers customers to use product or service from the merchant.

By participating in the Program, Affiliate agrees to use the Program in the manner specified in, and are bound by, these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety you are not authorized to register as an Affiliate or participate in the Program in any manner.

ModeSociety.com offers affiliates:

·       Up to 6% commission on all referred sales (but not including p&p charges or VAT)

·       30-day cookies*

·       Updated product feeds

·       Industry standard sized banners

·       Dynamic content links

·       Exclusive codes

·       Affiliate newsletter with tips, news and the latest offers.

·       Last referrer gets the commission.

·       Vat and Delivery charges do not qualify for commission.

·       Cross-device tracking enabled.

*This is the average cookie period; however, this may vary depending on your website's functionality.

Commission Groups

Please see below affiliate/publisher types and the relative new CPA rates:

CSS / Cashback / Loyalty /Student / Subnetworks / Buy-Now-Pay-Later / Closed User Groups / Discount Code: 6% New Customers, 3% Existing Customers Non-Royalty, 0.5% Existing Customers Royalty

Social Influencer / Content / Blog / Influencer Networks: 10% New Customers, 5% Existing Customers Non-Royalty, 5% Existing Customers Royalty

Display/Ad Networks/ Shopping Directories: 5% New Customers, 2% Existing Customers Non-Royalty, 0.5% Existing Customers Royalty

Tech: 6% New Customers, 2% Existing Customers Non-Royalty, 0.5% Existing Customers Royalty

Validations

All commissions will be validated within a 60-day period and ModeSociety.com reserves the right to decline commission on all returned goods. Affiliate/Publishers are only allowed to promote authorised codes that have been communicated by the Mode Society, otherwise the commissions will be declined.

PPC

Please note Mode Society will not pay commission to affiliates/publishers carrying out any unauthorised brand bidding and brand + product bidding for the duration the bidding takes place. Affiliates/Publishers are not permitted to bid on the brand or brand + product terms.

FULL TERMS AND CONDITIONS

Please note that failure to comply with these terms and conditions could result in your relationship being terminated and/or any commissions earned being reversed. Examples include, but are not limited to the following:

Voucher Code Affiliates

All voucher code affiliates are expected to adhere to the below:

Mode Society asks that affiliates adhere to the new guidelines from the Internet Advertising Bureau Affiliate Marketing Council (IAB AMC). Therefore, the terms & conditions of this affiliate programme have been set to reflect these guidelines:

1.         Using "Click to Reveal" when there is no valid or current code present is not permitted for affiliate publishers using "Click to Reveal" to show any deals / offers / sales instead of vouchers.

2.         Voucher code affiliate publishers must clearly detail the voucher offer that will be revealed by the click.

3.         A valid code or promotion is defined as a code that has been legitimately issued by Mode Society for use by affiliates and not a code that has been issued to consumers direct. This code or promotion will have an activation date and where necessary a deactivation date.

4.         Voucher code directories must contain clear categorisation and separation between deals / offers / sales and discount codes.

5.         Affiliate/Publishers are not allowed to promote/display any student discount offer unless previously agreed with the Mode Society team directly.

6.         Affiliate/Publishers are not permitted to promote/display Mode Society Black Friday’s and/or Cyber Week’s offers unless previously agreed with the Mode Society team directly.

Furthermore, the following offers cannot be promoted/displayed:

1.         Monetary discounts (e.g. £25 Off)

2.         Refer a Friend

3.         Mode Society App

4.         CRM/Social Codes (those are exclusive to the specific channel)

5.         Codes that belong to other affiliates/publishers

6.         Student discounts (unless previously agreed with the Mode Society team directly)

7.         Codes/offers that haven’t been specifically passed to you by Mode Society directly.

8.         All Morphe Products unless previously agreed with the Mode Society team directly.

Creative

Affiliates may not alter any of the creative or text links available through the Uppromote interface. Affiliates are also requested not to hardcode banners into their sites, so updates made to those through Uppromote may take immediate effect.

Anyone found infringing on these terms will receive a warning and may have commissions reversed. We reserve the right to withhold commission during this time. Continuous infringement of these terms will result in suspension.

I-frames

Affiliates may not put the Mode Society website into frames or use masked URLs.

Product Feed

The Mode Society data feed with up-to-the-minute pricing information will be refreshed each day.

Affiliates are requested to make every effort to maintain Mode Society most current pricing information in their promotions.

1. Pay Per Click search activity

Affiliates are not permitted to carry out any PPC search activity directing traffic to Mode Society except by special arrangement.

Affiliates generating traffic to their own sites must also abide by the following rules.

a.     Using the Mode Society brand term in the sub folder of the display URL (eg www.affiliate.com/Mode Society) – Not Allowed

b.     Using the Mode Society brand term in the sub domain of the display URL (eg www.ModeSociety.affiliate.com) – Not Allowed

c.      Using the Mode Society brand or a misspelling of the Mode Society brand in the display URL (eg www.SModeSociety.com) or (www.ModeSociety.com) – Not Allowed

d.     Using the Mode Society brand in the ad title – Not Allowed

e.     Using the Mode Society brand in the ad text – Allowed

f.       Bid on the brand term “ModeSociety” – Not Allowed

g.     Bid on misspellings or extensions of the brand (eg “ModeSocieti, SModeSociety, ModeSociety UK, ModeSociety.com”) – Not Allowed

h.     Bid on Mode Society brand + generic terms (eg “ModeSociety Shoes”) - Not Allowed

i.       Bid on the advertisers URL www. ModeSociety.com) – Not Allowed

j.       Show adverts on competitors’ brands – Not Allowed

k.      Please note affiliates are NOT allowed to bid on any variations of the brand name Mode Society. Bidding on any brand sold on ModeSociety is also not allowed.

l.       Mode Society and common misspelling should be added as negative terms to all affiliate paid search campaigns.

2. Discount code / voucher code websites

As standard all voucher code use needs to comply with the official IAB guidelines which can be found here:

a.     Affiliates/Publishers may only use discount codes which have been supplied to them by Mode Society directly. Please apply to Mode Society to obtain authorised codes for the Mode Society programme.

b.     Affiliates/Publishers must not display made up / invented discount codes on their site(s) or display discount codes that were intended for use in other channels or for other online affiliates/publishers.

                                                    i.     Affiliates/Publishers are not allowed to promote/display any student discount offer unless previously agreed with the Mode Society team directly.

c.      Under no circumstances are affiliates/publishers allowed to surreptitiously use i-frames to set cookies onto a user’s computer.

d.     Discount code affiliates/publishers with websites that encourage users to “click here to reveal offer / code” thus setting any cookie can only use this function if a voucher code exists for the Mode Society programme. If there is no voucher code available for the Mode Society programme affiliates/publishers must not use this method, as it leads to a poor user experience for potential Mode Society customers and can cause customer service issues.

e.     If a discount code has been issued to affiliates/publishers and it has an expiry date the affiliates/publisher must clearly display on its website(s) the expiry date of this discount so that the user can decide whether they want to go ahead and click the affiliates/publisher’s link.

f.       If affiliates/publishers wish to maintain expired discount codes on their sites for search engine optimisation reasons, they must display clear notification to the user that the discount has expired. This notification must be located right next to the expired discount code. The font size must be no smaller than the site(s) body text and the colour used must contrast clearly with the background It is not acceptable for the notification to be displayed a significant distance from the expired code.

4. Email Marketing

a.     All email marketing must be signed off by Mode Society and the account management team.

5. Linking

a.         Affiliates/Publishers are allowed to deeplink to a chosen offer or category on the Mode Society site.

b.        Linking through splash pages is not permitted (i.e. those on the Mode Society front page) as this interferes with the analytics package that is currently in place. Therefore, an affiliate tracking link must not include the splash page parameter (e.g. ?cm_re=Splash%20Box%20-_-Splash%20Box%205%20-_-Sale%20Coats) 

3. Cashback sites

a.     Please note that use of any promotional/voucher codes that haven’t been issued to you by Mode Society, will result in the sales being declined. This includes voucher codes that were exclusively given to another affiliate or codes from other online sources.

b.     In instances where exclusive codes have been issued to the cashback site directly by Mode Society, the user will be eligible to earn cashback.

c.      For any sites that display commission rates, please ensure that this is clearly stated on your websites to ensure customers/members are aware of these T&C!

4. Google Shopping Ads

a.         Please note that bidding on Bing and Google Shopping is not permitted by affiliates.

 5. Cookie’s

a.         We use a cookie to track people who have clicked on your link, so they need to be using cookies for us to track them.

b.        If a person doesn't allow cookies or clears their cookies then we can't track them so can't pay earnings on that person's activity.

c.         Cookies day is said on the Affiliate registration form. The tracking day will start from the time a customer clicks on the affiliate’s link or use the coupon. Within the cookie time, every order made by this customer at merchant website will automatically result in commissions to the affiliate.

Affiliate Approvals –

All affiliate sites are audited on sign up to ensure any brand compliance issue that may exist are met.

We reserve the right to approve or reject ANY Affiliate Program Registration in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Registration.

Removal from Referral Program

If an affiliate wishes to be removed from the affiliate program, they can do so by contacting: affiliate@modeosicety.com.

Validations, Commissions and Payment

Refer a customer to make a purchase on the Mode Society website’s, you will get a commission amount which is calculated based on Commission structure. Commission amount is dependent on order value and not including extra fee’s (vat, tax, shipping cost, etc).

All commissions will be validated on a 60 day period and Mode Society reserves the right to claw back commission on all returned goods.

 Payments will only be sent for transactions that have been successfully completed. Use of the Affiliate Program is subject to a fair use policy which gives merchant the right to review each and every referral order. Status of commission if displayed in Commission tab, any paid commission will be listed on Payment tab. Transactions that result in charge backs or refunds will not be paid out.

We reserve the right to modify this Agreement at any time as demanded by the business without prior notice.
